Flexibility
Mediation is a voluntary process designed to allow disputants to negotiate a settlement with the assistance of a neutral third party, the mediator. The process is highly flexible, with any settlement only binding upon all parties’ agreement and signature, and is particularly suited to cases where the parties wish to continue their commercial relationship.
The AMCC’s mediation services include the provision of detailed advice and guidance on the use of commercial mediation for resolution of disputes, including selection of a mediator, preparation of documents and bundles, what to expect on the mediation day and logistical support throughout.
Both where the parties have committed to mediation within contractual dispute resolution provisions, or where they choose to do so so as to avoid future or current litigation or arbitration, the AMCC Mediation Rules offer a clear and structure procedure to be followed.
